Privacy Policy

Scope. These policies apply to all orders, enquiries and services of Jiham Creatives Sdn. Bhd. (202301005141 / 1499060-W), trading as JIHAM Kaligrafi, across all our websites, WhatsApp channels and social media accounts. Where any other page, brochure, advertisement, FAQ or message states something different, this document prevails. These policies are governed by the laws of Malaysia. Personal Data Notice issued under the Personal Data Protection Act 2010 (Malaysia)

At Jiham Creatives Sdn. Bhd. ("Jiham", "we", "us"), we respect your privacy and are committed to protecting your personal data in accordance with the Personal Data Protection Act 2010 (PDPA) of Malaysia.

1. Personal Data We Collect

We collect only what we need to serve you:

Contact and delivery details — your name, phone number, WhatsApp number, email address, delivery and billing address;
Order details — the artwork, text, names, dates or verses you ask us to produce, your room or wall photographs, measurements, and your order and payment history;
Enquiry details — information you give us in a lead or enquiry form, such as your location and the type of space you wish to decorate;
Website activity — see Advertising & Analytics below.

We do not ask for and do not require your identity card number, passport number, race, religion, marital status, income, or details of your children or family members. Please do not send us these. If you send them to us anyway, we may delete them.

2. Purposes of Processing

We process your personal data to:

Prepare quotations, confirm designs, fulfil your orders, arrange delivery and installation, and process payments and refunds;
Respond to your enquiries and provide customer support and after-sales service;
Carry out our own internal marketing and promotional activities — sending you offers, catalogues, new-design announcements and promotional messages about Jiham's own products and services, by WhatsApp, SMS, email or telephone;
Keep internal records, train our staff, assure service quality, and carry out research and statistical analysis;
Comply with Malaysian law and respond to lawful requests from regulators, courts and enforcement agencies.

Promotional messages are sent by Jiham, about Jiham's own products and services only. We do not send you marketing on behalf of other businesses. You may opt out at any time — see Your Rights below — and doing so will not affect any order you have already placed.

3. Disclosure to Third Parties

Your personal data is kept confidential. We disclose it only to the following classes of third party, and only so far as needed to serve you:

Courier and logistics partners — to deliver your item;
Payment service providers — Stripe (cards and e-wallets), BCL (FPX online banking) and Atome (instalment payments) to process your payment. Where you choose an instalment plan, Atome is a separate credit provider and will process your data under its own privacy policy and credit assessment;
Installation contractors and artisans engaged by us — to produce and install your artwork at your premises;
Communication and IT service providers — including our WhatsApp Business provider, email provider and hosting provider;
Professional advisers, regulators and enforcement agencies — where required by law.

We do not sell, rent or trade your personal data to external marketers.

4. Advertising & Analytics

Our websites use analytics and advertising tools, including Google Analytics, the Meta Pixel and the TikTok Pixel. These set cookies and identifiers in your browser and share website activity with those providers so we can measure and target our advertising. This is separate from the contact details you type into a form. You can block these through your browser settings or device ad-tracking controls.

5. Is Supplying Your Data Obligatory?

Supplying your name, contact number and delivery address is obligatory — without them we cannot accept, produce, deliver or install an order. Everything else is voluntary. If you do not supply the obligatory data, we will not be able to proceed with your order or enquiry.

6. Retention

We keep your personal data only for as long as it is needed for the purposes above. Order and payment records are kept for seven (7) years to meet Malaysian tax and accounting requirements. Marketing contact details are kept until you opt out. Enquiry records for enquiries that do not become orders are kept for twenty-four (24) months. After that, data is deleted or anonymised.

7. Data Security

We implement appropriate administrative, technical and physical safeguards to protect your data against unauthorised access, alteration or loss. No system is perfectly secure, and we cannot guarantee the security of information you send us over the internet or messaging apps.

8. Your Rights

Under the PDPA you have the right to:

Request access to the personal data we hold about you;
Request correction of data that is inaccurate, incomplete, misleading or out of date;
Withdraw your consent to our processing of your personal data;
Require us to stop processing your data for direct marketing at any time (section 43, PDPA 2010);
Limit the processing of your data for particular purposes.

To exercise any of these rights — including asking us to remove your phone number or email from our marketing list — contact [email protected] or +60 3-8691 8711. You do not need to give a reason. There is no charge for a marketing opt-out. We will action marketing opt-outs immediately on receipt and respond to access or correction requests within twenty-one (21) days. We may need to verify your identity before releasing data. Where we must keep certain records by law (for example tax records), we will tell you.

Notis ini dikeluarkan di bawah Akta Perlindungan Data Peribadi 2010.

Data yang kami kumpul: nama, nombor telefon dan WhatsApp, alamat e-mel, alamat penghantaran dan bil; butiran tempahan anda termasuk teks, nama, tarikh atau ayat yang anda mahu kami hasilkan, gambar dinding dan ukuran; butiran pertanyaan anda; serta aktiviti laman web. Kami tidak meminta nombor kad pengenalan, passport, bangsa, agama, taraf perkahwinan, pendapatan atau butiran anak dan ahli keluarga anda.

Tujuan: menyediakan sebut harga, mengesahkan reka bentuk, memenuhi tempahan, mengatur penghantaran dan pemasangan, memproses bayaran dan bayaran balik; menjawab pertanyaan dan memberi khidmat selepas jualan; menjalankan aktiviti pemasaran dan promosi dalaman kami sendiri — menghantar tawaran, katalog, pengumuman reka bentuk baharu dan mesej promosi mengenai produk dan perkhidmatan Jiham melalui WhatsApp, SMS, e-mel atau telefon; menyimpan rekod dalaman, melatih kakitangan dan analisis statistik; serta mematuhi undang-undang Malaysia.

Mesej promosi dihantar oleh Jiham mengenai produk Jiham sendiri sahaja. Kami tidak memasarkan produk perniagaan lain kepada anda.

Pendedahan kepada pihak ketiga: rakan kurier dan logistik; penyedia perkhidmatan bayaran (Stripe, BCL/FPX, Atome); kontraktor pemasangan dan tukang seni yang dilantik kami; penyedia perkhidmatan komunikasi dan IT; penasihat profesional, pihak berkuasa kawal selia dan agensi penguatkuasaan apabila dikehendaki undang-undang. Kami tidak menjual atau memperdagangkan data anda kepada pemasar luar.

Wajib atau tidak: nama, nombor telefon dan alamat penghantaran adalah wajib. Tanpa maklumat tersebut kami tidak dapat menerima, menghasilkan, menghantar atau memasang tempahan anda. Selain itu adalah sukarela.

Tempoh simpanan: rekod tempahan dan bayaran disimpan tujuh (7) tahun bagi keperluan cukai dan perakaunan. Butiran pemasaran disimpan sehingga anda menarik diri. Rekod pertanyaan yang tidak menjadi tempahan disimpan dua puluh empat (24) bulan.

Hak anda: memohon akses kepada data anda; memohon pembetulan data yang tidak tepat atau tidak lengkap; menarik balik persetujuan anda; dan menghendaki kami berhenti memproses data anda untuk pemasaran langsung pada bila-bila masa (seksyen 43, APDP 2010).

Untuk melaksanakan hak ini — termasuk meminta kami membuang nombor telefon atau e-mel anda daripada senarai pemasaran — hubungi [email protected] atau +60 3-8691 8711. Anda tidak perlu memberi sebab dan tiada sebarang caj untuk menarik diri daripada pemasaran. Permintaan berhenti pemasaran akan dilaksanakan serta-merta; permohonan akses atau pembetulan akan dijawab dalam dua puluh satu (21) hari.
