Terms of Service

Scope. These policies apply to all orders, enquiries and services of Jiham Creatives Sdn. Bhd. (202301005141 / 1499060-W), trading as JIHAM Kaligrafi, across all our websites, WhatsApp channels and social media accounts. Where any other page, brochure, advertisement, FAQ or message states something different, this document prevails. These policies are governed by the laws of Malaysia. Overview

This website is operated by Jiham Creatives Sdn. Bhd., trading as JIHAM Kaligrafi. Throughout the site, "we", "us" and "our" refer to Jiham Creatives Sdn. Bhd. By visiting our site, placing an order, paying a deposit, or approving a design, you engage in our Service and agree to be bound by these Terms of Service, including the policies referenced in them. If you do not agree, you may not use the Service.

1. Online Store Terms

By agreeing to these Terms you represent that you are at least the age of majority in your state or province of residence. You may not use our products for any unlawful purpose, nor violate any laws in your jurisdiction (including copyright laws). You must not transmit any worms, viruses or code of a destructive nature. A breach of these Terms results in immediate termination of your Service.

2. General Conditions

We reserve the right to refuse service to anyone for any reason at any time. You understand that your content (excluding payment card information) may be transferred unencrypted over various networks. Payment card information is always encrypted in transit. You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, our artworks, or our designs without our express written permission.

3. Artistic Licence & Product Variations

Our products are handcrafted. By purchasing, you acknowledge that:

Wood grain: natural wood may vary in grain, knots, colour and texture. These are natural characteristics, not defects.
Handwriting: as our calligraphy is hand-written or hand-designed, slight variations in strokes or layout compared with digital mockups may occur. We reserve the right of artistic interpretation in the final output.
Colour and dimensions: we make every effort to display colours and images accurately, but screens vary and slight variations in frame texture, printing and dimensions may occur. We cannot guarantee your screen's colour rendering matches the finished physical artwork.

4. Design Approval & Customer Errors

For custom work, all specifications must be confirmed by you in writing before production begins. The design proof you approve is final. We are not responsible for typographical or spelling errors, wrong names, wrong dates or wrong verses where the text was produced exactly as you submitted or approved it. Please check your proof carefully before approving and paying. Once production has started, modifications and cancellations cannot be accommodated.

5. Calligraphy Accuracy & AI-Generated Visuals

To help you visualise our art in various spaces, we use Artificial Intelligence to generate room mockups, interior concepts and layout inspirations.

Conceptual layouts only: these digital mockups are strictly for visual inspiration and conceptualisation.
AI calligraphy limitations: AI tools frequently produce inaccuracies or structural errors when rendering Arabic text and traditional Islamic calligraphy. Text visible in our AI-generated concept images does not represent our actual work and must not be read as accurate calligraphy.
Commitment to authenticity: all final physical artworks are meticulously crafted by qualified calligraphers, referenced against a Mushaf Al-Quran certified by KDN, and human-verified before release.

6. Intellectual Property

All designs, artwork and content produced by Jiham Creatives Sdn. Bhd. remain our intellectual property. Purchasing a physical piece does not grant you the right to reproduce, scan, digitise, or resell the design for commercial purposes without our written consent.

7. Accuracy of Information, Prices and Modifications

We are not responsible if information on this site is not accurate, complete or current; the material is provided for general information only. Prices are subject to change without notice, and we may modify or discontinue the Service or any product at any time without notice and without liability to you or any third party.

8. Errors, Inaccuracies and Omissions

Occasionally our site may contain typographical errors or inaccuracies relating to product descriptions, pricing, promotions or availability. We reserve the right to correct such errors and to change, update or cancel an affected order at any time without prior notice. If we cancel an order for this reason, we will refund you in full.

9. Accuracy of Billing and Account Information

We reserve the right to refuse any order you place with us, and to limit or cancel quantities purchased per person, per household or per order. You agree to provide current, complete and accurate purchase and account information for all purchases.

10. Optional Tools & Third-Party Links

We may provide access to third-party tools over which we neither monitor nor have control, and we have no liability arising from your use of them. Certain content, products and services available via our Service may include materials from third parties; we are not responsible for examining or evaluating third-party websites or their accuracy.

11. User Comments, Feedback and Submissions

If you send creative ideas, suggestions, proposals or other materials ("comments"), you agree that we may at any time, without restriction, edit, copy, publish, distribute, translate and otherwise use them in any medium. You agree that your comments will not violate any right of any third party, including copyright or trademark.

12. Personal Information

Your submission of personal information through the store is governed by our Privacy Policy.

13. Prohibited Uses

You are prohibited from using the site or its content: (a) for any unlawful purpose; (b) to solicit others to perform or participate in unlawful acts; (c) to violate any regulations, rules, laws or local ordinances; (d) to infringe our intellectual property rights or those of others; (e) to submit false or misleading information; (f) to upload malicious code.

14. Disclaimer of Warranties; Limitation of Liability

We do not guarantee, represent or warrant that your use of our Service will be uninterrupted, timely, secure or error-free. You expressly agree that your use of, or inability to use, the Service is at your sole risk. To the fullest extent permitted by Malaysian law, Jiham Creatives Sdn. Bhd., its directors, officers, employees and affiliates shall not be liable for any indirect, incidental, special, punitive or consequential damages arising from your use of the Service or any products procured using it. Our maximum aggregate liability for any claim shall not exceed the purchase price actually paid by you for the product or service giving rise to the claim. Nothing in these Terms excludes any liability that cannot be excluded under Malaysian law, including under the Consumer Protection Act 1999.

15. Indemnification

You agree to indemnify, defend and hold harmless Jiham Creatives Sdn. Bhd. and our affiliates, partners, officers and employees from any claim or demand, including reasonable legal fees, made by any third party arising out of your breach of these Terms of Service.

16. Severability & Termination

If any provision of these Terms is determined to be unlawful, void or unenforceable, that provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the remaining provisions are unaffected. These Terms are effective unless and until terminated by either you or us.

17. Entire Agreement & Governing Law

These Terms of Service, together with the policies posted by us, constitute the entire agreement between you and us. They are governed by and construed in accordance with the laws of Malaysia, and disputes are subject to the exclusive jurisdiction of the courts of Malaysia.

18. Changes to These Terms

We may update these policies from time to time by posting the revised version. The version in force at the time you place your order is the version that applies to that order. It is your responsibility to check this page periodically.
